1. Scope of Services & Role of SMS Tours and Travels
SMS Tours and Travels operates as a facilitator and aggregator connecting travelers with verified third-party service providers, including airlines, Indian Railways, bus operators, car rental agencies, hotels, and tour operators.
- Intermediary Status: SMS Tours and Travels does not own, control, or directly operate airlines, hotels, train services, or third-party transport fleets unless explicitly stated.
- Service Standards: While we endeavor to partner exclusively with reputable service providers, SMS Tours and Travels shall not be held directly liable for service deficiencies, delays, schedule modifications, or failures caused by third-party suppliers.

2. General Booking & Payment Terms
- Accuracy of Information: Customers must provide accurate personal details (Full Name, Age, Gender, ID Details, and Contact Information) matching their official government-issued identity proofs. SMS Tours and Travels shall not be held responsible for ticket cancellations, boarding denials, or penalties resulting from incorrect details provided by the customer.
- Pricing & Availability: All package rates, vehicle tariffs, and bookings are subject to real-time availability and dynamic pricing until the booking is confirmed upon receipt of the required advance or full payment.
- Payment Processing: All online payments made via https://smstravel.in/ are processed through secure, encrypted payment gateways. Any applicable gateway transaction charges, banking fees, or currency conversion rates shall be borne entirely by the customer.
- Accuracy of Information: Customers must provide accurate personal details (Full Name, Age, Gender, ID Details, and Contact Information) matching their official government-issued identity proofs. SMS Tours and Travels shall not be held responsible for ticket cancellations, boarding denials, or penalties resulting from incorrect details provided by the customer.

3. Service-Specific Terms and Conditions
A. Car & Vehicle Rental Services
- Usage Limits: Vehicle rentals are booked based on pre-defined kilometer and time allowances (e.g., Local 8 Hours / 80 KMs or Outstation per-day KM caps). Any additional kilometers or hours driven beyond the package limit will incur extra charges as per the applicable vehicle tariff rates.
- Tolls, Parking & Allowances: Unless explicitly listed as included in the package, toll taxes, parking fees, state permit charges, entry taxes, and driver night allowances are extra and payable directly by the customer.
- Vehicle Breakdown Policy: In the rare event of a mechanical breakdown during a local or outstation journey, SMS Tours and Travels will make every reasonable effort to arrange a replacement vehicle of a similar category as quickly as possible. Guests are expected to extend reasonable cooperation until a replacement vehicle is deployed based on local availability.
- Code of Conduct & Property Damage: Passengers are required to maintain courteous and respectful conduct toward the driver. Any physical damage caused to the vehicle's interior or exterior by the passenger(s) will be billed directly to the customer. Smoking and the consumption of alcohol or prohibited substances inside the vehicle are strictly forbidden.

- Itinerary Modifications: Sightseeing schedules, routes, or the sequence of visits may be altered or adjusted due to adverse weather conditions, heavy traffic, local government restrictions, force majeure events, or operational safety concerns.
- Inclusions & Exclusions: Only items explicitly listed under the "Package Inclusions" section are covered. Personal expenses, extra meals, entry tickets, activity charges, boating fees, or unmentioned services remain strictly excluded.
- Hotel Check-In / Check-Out: Standard hotel check-in time is generally between 12:00 PM and 02:00 PM, and check-out is between 10:00 AM and 11:00 AM. Early check-in or late check-out requests are subject to room availability and hotel policies, and may incur additional charges payable directly to the property.

- Hotel Policies: Extra mattress charges, child policies, pet restrictions, room allocation, and property amenities are strictly governed by individual hotel regulations.

- Delays & Schedule Changes: SMS Tours and Travels accepts no liability for flight delays, rescheduling, cancellations, or missed onward connections caused by airlines, weather conditions, or aviation authorities.
- Convenience Charges: Convenience fees or agency service fees collected by SMS Tours and Travels at the time of booking are strictly non-refundable in the event of flight cancellation.
- Airline Fare Rules: Flight bookings, date amendments, seat selection, baggage allowances, and cancellation penalties are strictly governed by the respective airline's terms and fare rules.
- Delays & Schedule Changes: SMS Tours and Travels accepts no liability for flight delays, rescheduling, cancellations, or missed onward connections caused by airlines, weather conditions, or aviation authorities.
- Convenience Charges: Convenience fees or agency service fees collected by SMS Tours and Travels at the time of booking are strictly non-refundable in the event of flight cancellation.
E. Train Bookings
- IRCTC Regulations: Train tickets issued through SMS Tours and Travels are subject to Indian Railways (IRCTC) booking guidelines, chart preparation rules, and cancellation policies.
- Identity Verification: Passengers traveling on e-tickets must carry a valid original photo ID proof matching the passenger names printed on the Electronic Reservation Slip (ERS).
- Waitlisted Tickets: E-tickets that remain fully waitlisted after final chart preparation are automatically canceled by IRCTC, and applicable refund procedures apply.
- IRCTC Regulations: Train tickets issued through SMS Tours and Travels are subject to Indian Railways (IRCTC) booking guidelines, chart preparation rules, and cancellation policies.
- Identity Verification: Passengers traveling on e-tickets must carry a valid original photo ID proof matching the passenger names printed on the Electronic Reservation Slip (ERS).

- Reporting Time: Passengers must report to the designated boarding location at least 15–30 minutes prior to the scheduled departure. Neither SMS Tours and Travels nor the bus operator shall be held liable for missed buses resulting from late arrivals.
- Seating & Route Changes: Bus operators reserve the right to modify bus types, seating configurations, or route timings due to technical or operational requirements.

- Deductions: Applicable cancellation penalties imposed by airlines, hotels, railways, or transport operators will be deducted in full, along with SMS Tours and Travels' administrative service fees.
- Refund Timeline: Eligible refunds will be processed back to the original source payment account within 7 to 14 business days after receiving confirmation and funds from the respective service providers.
- Non-Refundable Services: Unutilized services, voluntary trip abandonments, missed transfers, or late arrivals due to personal reasons are strictly non-refundable.
- Cancellation Request: All cancellation requests must be formally submitted in writing via email or through our official customer support channels.

6. Limitation of Liability & Force Majeure
- Limitation of Liability: To the maximum extent permitted by applicable law, SMS Tours and Travels shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from flight delays, accidents, loss of baggage, injury, illness, death, or personal property loss during travel.
- Force Majeure: SMS Tours and Travels shall not be held liable for failure or delay in fulfilling services caused by acts of God, extreme weather events, floods, natural disasters, epidemics, pandemics, war, civil unrest, strikes, government restrictions, or any unforeseen event beyond our reasonable control.
